Legality of Australia’s Overseas Law Enforcement Operations Faces Court Challenge

Australia’s handling of an overseas operation to return accused underworld figure Masood Zakaria from Türkiye is facing legal scrutiny, with a former military contractor involved in the mission reportedly uncontactable ahead of a court hearing.

According to the ABC, the former SAS soldier was among private contractors hired to escort Zakaria to Australia in 2023. The Australian Federal Police paid the contracting company more than A$1 million for its involvement.

Zakaria is challenging the legality of his return, arguing that he was unlawfully removed from Türkiye rather than brought back through a lawful extradition process. He faces charges linked to the 2021 killings of Salim and Toufik Hamzy and denies the allegations against him.

The proceedings could examine the legal boundaries of overseas law enforcement, the role of private contractors and the accountability of Australian authorities when operations take place outside the country.
